Purpose of the Funding Information
The Funding Information is for tertiary education organisations (TEOs) and the Tertiary Education Commission (TEC). It describes the operational requirements applying to Student Achievement Component (SAC),TEO Component funding,and Industry Training Funding provided by the TEC. It also provides information on approval of qualifications for learner access to student allowances and the Student Loan Scheme.
Scope of the Funding Information
The Funding Information describes:
- the policies under which the TEC allocates and delivers funding, including statutory requirements
- the rules of operation of the funding mechanisms
- eligibility criteria for access to funding
- the requirements that relate to funding, and the conditions the TEC attaches to funding
- reporting requirements for funding
- learner enrolment requirements
- approval of qualifications for learner access to the student allowances and the Student Loan Scheme.
The information also includes:
- explanatory notes and guidance in applying the rules and conditions
- examples to assist TEOs in applying the rules and conditions.
Funding rules and conditions
Within the Funding Information the terms 'rule' and 'condition' are used as follows.
Rules
A rule is an enforceable requirement associated with funding and can be either a statutory requirement, a rule of a mechanism determined by the Minister, or an operational rule that is developed by the TEC to ensure that the Minister's determinations are implemented. The TEC has authority to enforce rules through:
- the broad rules of the relevant funding mechanism determined by the Minister of Education under sections 159L(1) and (2) of the Education Act 1989 (the Act)
- the detailed implementation rules of the relevant funding mechanism determined by the TEC under section 159O of the Act
- other financial information and records required to be kept or supplied under section 159YD of the Act (non-Tertiary Education Institutions (non-TEIs)), or section 203 of the Act (Tertiary Education Institutions (TEIs))
Note: There may be occasions when the TEC will require additional information under section 159ZE of the Act that has not been set out in the Funding Information
- other statutory requirements imposed by Acts of Parliament.
Conditions
A condition is an enforceable requirement attached to funding. A condition may be imposed under legislation or by the Minister's 159L determination, or an operational detail developed by the TEC to implement the specified condition.
The TEC has authority to enforce conditions through:
- the Minister’s directive under section 159L(3)(d), or section 159YC(2)(a) or 159ZD(2)(b) of the Act
- conditions imposed by the TEC under section 159YC or 159ZD(2)(a) of the Act
- the financial, statistical, or other information required to be supplied by TEOs to the TEC as a condition imposed under section 159YC(1) or 159ZD(1) of the Act.
Note: There may be occasions when the TEC will require additional information under section 159YC(1) or 159ZD(1) of the Act that has not been set out in the Funding Information.
How the rules and conditions appear
All rules and conditions must be adhered to by TEOs receiving funding or seeking learner access to student allowances and the Student Loan Scheme. Rules are displayed throughout the funding documentation in the following format:
Rule SAC014: Private training establishments require approval by the New Zealand Qualifications Authority (NZQA) for all qualifications.
Qualifications offered by distance delivery require NZQA approval of distance delivery.

Condition SAC087: The Fee/Course Costs Maxima limits apply to fees charged to all the following:
- All domestic students enrolled in courses subject to the policy, whether those students attract Student Achievement Component funding or not
- International PhD students who are enrolled as domestic students, but not to those enrolled as foreign students.

Updates to Funding Information
The Funding Information provides information for TEOs to give effect to the purpose of the different funds.
While the TEC is committed to a no surprises approach, there may be occasions when new government policy must be implemented, requiring changes to the Funding Information. Any changes to the Funding Information will be noted on the affected page.
