Fees policy monitoring and reporting

The monitoring process for the fees policy is:

  1. the TEO submits a Single Data Return (SDR)
  2. we provide a list of fee/course costs that are above the AFML or PFIL in 2010, or AMFM in 2011, for SAC-funded courses. We invite the TEO to explain why funding should not be withdrawn
  3. the TEO investigates and corrects any mistakes, including refunding the overcharged components of fee/course costs as applicable, in accordance with Condition SAC110[1].

TEOs must comply with the reporting requirements set out in the Education Act 1989 and the funding information. Funding may be withdrawn where there is non-compliance with policy or reporting conditions, in accordance with Condition SAC109[2]

    Condition SAC110: Refunding overcharged fees

    If a tertiary education organisation (TEO) breaches the fees policy, but subsequently corrects its fee/course costs, the TEO must promptly refund the overcharged component of the fee/course costs as applicable.

    If a learner has borrowed from StudyLink to pay fee/course costs, the TEO must refund StudyLink - not the learner.

    Condition SAC109: AMFM policy - non-compliance

    If a tertiary education organisation does not comply with the Annual Maximum Fee Movement policy as set out in the Education Act 1989, the Minister's funding determination, and the Rules and Conditions published by the Tertiary Education Commission (TEC), the TEC may withdraw Student Achievement Component funding approval for the courses involved.
