Enrolment contract

An enrolment contract is formed when a learner accepts an enrolment offer by signing it, and then returns the form to the TEO.

It is an agreement between a learner and a TEO for a teaching period specified by the TEO, such as an academic year, which:

  • establishes the basis on which a learner studies with a TEO
  • protects the interests of the learner and the TEO
  • specifies the period for a learner to withdraw with a refund of fees/course costs
  • supports the TEO to claim SAC funding for eligible students
  • is used by the learner to access student allowances and loans.

Learner breaches of an enrolment contract generally invalidate the enrolment for SAC funding, although exceptions are outlined in Rule ENR061[1].

    Rule ENR061: Enrolment contract - learner breaches

    If a learner breaches their enrolment contract, for example the learner fails to pay their tuition fees (including compulsory course costs), the enrolment is invalid for Student Achievement Component funding unless both the following are met:

    • The learner has made a commitment to pay tuition fees (through the enrolment contract or through attendance on the course)
    • The tertiary education organisation enforces that commitment.
